Is THC-O Legal?
State-by-state legal guide — updated for 2026 federal changes.
What is THC-O?
THC-O (THC-O-acetate) is a synthetic cannabinoid created in a laboratory by acetylating THC. It does not occur naturally in the cannabis plant. THC-O is reportedly 2-3 times more potent than Delta-9 THC. The DEA issued a statement in February 2023 declaring THC-O a controlled substance because it is synthetically derived.
Federal Status
THC-O is already federally illegal as a synthetic controlled substance under DEA guidance. The 2026 law does not change its status — it was never legal.
